This Privacy Policy is designed with an intent to customise the needs and to cater personalised services to the users, and it is important that you have a comprehensive understanding of our personal information collection and usage practices, while ensuring that ultimately, you have control of your personal information provided to KENT CamEye.

This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects you.   5. Country refers to: Uttar Pradesh, India
  6. Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  7. Personal data is any information that relates to an identified or identifiable individual.
  8. Service refers to the Application.
  9. Service provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  10. Usage data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  11. You means, the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

This Privacy Policy explains how KENT CamEye collects, uses, discloses, processes and protects any personal information that you give us or that we collect from you. Should we ask you to provide certain information by which you can be identified when you use the services on our platform, it will only be used in accordance with this Privacy Policy and/or our terms and conditions for users. Under this Privacy Policy, “personal information” means information that can be used to identify an individual directly or indirectly, either from that information alone or from that information combined with other information KENT CamEye has access to about that individual, except as otherwise specifically provided by applicable laws in your region. We will use your personal information strictly in accordance with this Privacy Policy/

WHAT INFORMATION IS COLLECTED BY US

  1. Information you provide to us: When you install Kent CamEye, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to: Email address, Phone number, First name, Last name and Usage data. Usage Data may include information such as your device's internet protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Kent CamEye service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our service or when you access the service by or through a mobile device. When you add a Kent CamEye camera device on mobile app, you’ll be asked for certain basic permission to access photos, media, and files on your device. You will be asked to provide with a device name, image etc. while setting up CamEye device, this information is used to personalize your experience – for example, to tell you which device is triggering a notification.
  2. Environmental data from the camera's sensors: We collect data from several sensors built into Kent CamEye device. These sensors collect data such as temperature, noise level and ambient light in the vehicle. By recording this information, Kent CamEye can know, for instance, whether it's dark and it should turn on night vision.
  3. GPS and vehicle use data: Kent CamEye device is powered with GPS and accelerometer sensors, which collect data such as location co-ordinates, vehicle speed, driving behaviour. By using this data, Kent CamEye can send you alerts based on settings.
  4. Video and audio signals and data: Kent CamEye enables you to determine the purpose and the means for which you collect video and audio signals data. When you enable the recording or streaming features of your Kent CamEye, we may record and process video and/or audio recordings from the device, subject to your instruction, configuration and settings. This may include capturing and emailing to you portions of this data as part of a notification or analyzing the data to identify faces or other events. If you instruct us by setting up your camera and choosing to receive mobile notifications, we may process information from your Kent CamEye device to send you alerts when something happens. In addition, if you have the recording features enabled, we will capture, process and retain video and audio data recordings from your device for the duration of your recording subscription period (for example, 7, 14 or 30 days) and you will be able to access those recordings using the Services during that time.
  5. Face image: If you choose to use the unknown driver alert feature on your Kent CamEye, we will process face images and underlying face prints for the purpose of enabling your device to recognize familiar driver and notify you of any unknown driver. Using the app and your account, you control whether this biometric processing occurs or not. Depending on where you live and how you configure the Products and Services, you may need to get explicit consent to scan the faces of people sitting in your car.
    You are allowed to add faces by taking a picture from the camera or by uploading one from the gallery using the mobile application, crop it as per requirement and assign a name to it before saving it on the secured server. No other image edition other than cropping is performed.
  6. Shared content: CamEye enables you to share the device. You may share the live streaming and video playback for both, inside camera and outside camera. We will share the information to the other user, subject to your permissions and settings. We will collect and store information that will allow us to save or share your content at your instruction through the Services.

WHAT PERSONAL INFORMATION IS COLLECTED

  1. Additional authorized users: Kent CamEye may provide you with the ability to enable additional authorized users to access your account. If you do so, the additional authorized users may control and view all of your devices and content. Invited users may also add additional authorized users to your account, so be careful to add only those you trust. An invited user must have or create a Nest account, and information about invited users (like email address, name or changes to product settings) will be stored with your account.
  2. Email addresses: When you create a Kent CamEye account, we collect and store your email address. From that point forward, your email address is used for communications from Kent CamEye. In addition, Nest may provide you with the ability to enable individuals to access your account as additional authorized users, or to invite other individuals such as friends or family to share access to your content such as recorded video footage. We will ask you for the email address of any such individuals and automatically send an email invitation on your behalf. Kent CamEye stores this information to send this email, to register your friend if your invitation is accepted, and to track the success of our invitation services.
  3. Mobile phone number: When you create a Kent CamEye account, we collect and store your mobile phone number. Mobile phone numbers are used to send SOS notifications when it's requested from the Kent CamEye device. It is also used to send alert notifications in case there is unavailability of internet.
  4. Basic profile information: Your account allows you to provide certain basic profile information like your name and profile photo. Names and profile photos may be shown to others in connection with the Services. In addition, if you download the Kent CamEye Mobile App, we may collect and store your mobile device identifiers (such as IDFA, AAID, or other device identifiers). For example, if you invite someone as an additional authorized user, he or she may be able to see your name and photo. You should only use photos you are willing to make public.

HOW THIS PERSONAL INFORMATION CAN BE USED

We may use personal information for the following purposes:

  1. Maintain and improve our services: To maintain, improve, and develop our service, including monitoring the usage of our service and services provided by Kent CamEye or through your device, by Analyzing and developing statistics on use of our products and services to better improve our products and services.
  2. Manage your account: To manage your registration as a user of the service. The Personal Data you provide gives you access to different functionalities of the service that are available to you as a registered user.
  3. Contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates of device and app, customer support, when necessary or reasonable for their implementation.
  4. Provide you with personalized information:Provide you news, special offers and general information about other goods, services and events, including promotional materials and updates, which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.
  5. For business transfers: We may use your information for our business operations or legal obligations to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  6. For the performance of a contract: For development, compliance and undertaking of the purchase contract for the products, items or services you have purchased or of any other contract with us through the Service.
  7. Manage requests: To attend and manage your requests to us.
  8. For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our service, products, services, marketing, and your experience and provide local services without communicating with our servers.

Here are more details on how we use your information (which may include personal information):

  1. Setting up your kent cameye account: Personal information collected when creating a Kent CamEye Account on our web sites or through our mobile devices is used for creating the personal CamEye Account and profile page for the user.
  2. Providing location-based services: When using Kent CamEye and accessing Kent CamEye devices, we may use information about your location to determine the time zone of the device. This will ensure that the device accurately displays the correct time and login service area. It will also optimize user experience by providing services such as advance activation of the corresponding device at a time set by the user. You can turn off this feature at any time by going to device settings or by discontinuing your use of this application.
  3. Accessing devices: The authenticity of devices that are operated through the app must be verified. We therefore need to confirm the legal identity of the device by consulting the IMEI information.
  4. Displaying of device status: This allows you to view the status of the device remotely that you can check at any time whether or not the device is running.
  5. Setting up automated tasks: The event information reported by your device can be used to create your own, personalized automated tasks.
  6. Providing push services: Mobile Phone Numbers will also be used for the Kent CamEye push service, which sends device notifications to the user. You can turn off this feature at any time by changing the preferences listed under "Notification Settings"
  7. Sending notifications: We may occasionally use your personal information to send important notifications, for example, notifications about the status of device malfunctions; your customized device push notifications; and changes to our terms, conditions, and policies.
  8. Facial recognition: The face images can be used to identify a known driver using the Kent CamEye device. In case the face image is not available with the device and it detects any, an ‘Unknown Face’ alert will be sent to you. This Face Data is controlled by you and can be deleted as per will. Moreover, this Face Data is saved in the encrypted form on a secured server.

WITH WHOM WE SHARE YOUR INFORMATION?

We do not sell any personal information to third parties. We may disclose your personal information to third parties (as defined below) in order to provide products or services that you have requested.

  1. With service providers: We may share your personal information with service providers to monitor and analyze the use of our service, to contact you.
  2. For business transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  3. With affiliates: We may share your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  4. With business partners: We may share your information with Our business partners to offer You certain products, services or promotions.

Your consent to Kent CamEye will engage sub-processors for the processing of your personal information. Please understand that if, in any of the situations described below, Kent CamEye shares your information with a third-party service provider, Kent CamEye will contractually specify that the third party is subject to practices and obligations to comply with applicable local data protection laws. Kent CamEye will contractually ensure compliance by any Third Party Service Providers with the privacy standards that apply to them.

Sharing with third-party service provider

In order to operate successfully and provide you with the full functionality of our products and services, We may disclose your personal information to other third-party service providers (our mailing centers, delivery services providers, telecommunications companies, data centers, data storage facilities, customer service providers, advertising and promotional service providers, and agents representing Kent CamEye) [affiliated companies and/or other third parties] (collectively referred to as "third-party service providers"). Such third-party service providers may process your personal information on Kent CamEye's behalf or for one or more of the purposes listed above. When using certain mobile applications on our devices, we may share your IP address with third parties in order to provide you with some of the services you requested. Transfer of your personal data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

Data protection and privacy laws in your country may impose certain responsibilities on you and your use of dashcam. You (not KENT CamEye) are responsible for ensuring that you comply with any applicable laws when you use Kent CamEye. For example, you may need to display a notice that alerts your fellow travellers or passengers while boarding the car that you are using KENT CamEye and/or obtain their explicit consent depending on the purpose and the means of your processing activities. Note in particular that recording and sharing clips that involve other people, public spaces and/or scans of peoples’ faces may affect individuals’ privacy and data protection rights.

In general, for purposes of applicable law KENT CamEye is a controller of the information collected in connection with the Products and Services. However, in the case of “Video and audio signals and data” and “Facial recognition to enable Unknown Driver Alert feature and stealth mode” customer are the controller of these data and KENT CamEye is only a processor.
For providing measurement, analytics, and other business services where we are processing Data as a controller. The legitimate interests we rely on for this processing are:-

  • To provide accurate and reliable reporting to businesses and other partners, to ensure accurate pricing and statistics on performance, and to demonstrate the value our partners realise using our Services; and
  • In the interests of businesses and other partners to help them understand their customers and improve their businesses, validate our pricing models, and evaluate the effectiveness and distribution of their services and messages, and understand how people interact with them on our Services.
  • For providing marketing communications to you.

The limited situations in which we use your information, with your consent, include when we operate, provide, and refine our Services, and use your information to help. We collect information on when and where clips are created, and how our apps are used.
